Representative commercial litigation experience includes:

  • Representation of several foreign telecommunications providers in action alleging infringement of patents relating to international text and SMS messaging; obtained dismissal of clients for lack of personal jurisdiction.  Technology Patents LLC v. Deutsche Telekom AG, et al., United States District Court-Maryland.
  • Representation of financial institution in Enron securities litigation.
  • Representation of NASCAR race team in claims against the team’s former sponsor for breach of sponsorship agreement.
  • Representation of HOA management company against a regional bank in action for wrongful setoff of deposit funds and breach of commercial banking agreement.
  • Representation of textile broker against Indian manufacturer for breach of contract and delivery of non-conforming goods.
  • Representation of administrator of estate against claims of breach of fiduciary duty.
  • Representation of financial institution against lessees under finance leases for breach of the lease and claim and delivery of goods.
  • Representation of major holder of timberland and other undeveloped properties in federal court in the Eastern District of North Carolina in defense of a multi-million dollar claim for breach of contract and specific performance relating to a purported contract for the sale of unimproved timber land. Mr. Alexander and his colleagues obtained summary judgment in his client’s favor on all issues.
  • Representation of a major manufacturer of electrical equipment in a complex ERISA matter in which certain plan participants made claims against Mr. Alexander’s client arising under historical plan documents; obtained dismissal on separate motions to dismiss and for summary judgment.  Colin v. Marconi Commerce Systems Employees’ Retirement Plan, 335 F.Supp. 2d 590 (M.D.N.C. 2004).
  • Representation of financial institution in obtaining injunctive relief to proceed with securitization transaction and defense of related claims of breach of contract and alleged trade secret misappropriation.
  • Representation of an owner of two high-rise office buildings in Houston, Texas in claims against the manufacturer of defective window units installed on two 45 story office buildings.
  • Representation of successor to credit card issuer in action to enforce arbitration agreement in amended credit card agreement.
  • Representation of a military contractor and shipbuilder (defendant/counter- plaintiff) in a contract dispute with a subcontractor
  • Representation of commercial mortgage lender in action to enforce commercial mortgage prepayment provision.
  • Representation of the North Carolina Coalition for Humane Euthanasia and the Humane Society of Union County, Inc. in claims against the Union County Sheriff’s office for use of inhumane euthanasia practices and against the operator of a puppy mill who kept over 250 small-breed dogs in rabbit cages in a barn in her backyard.
  • Representation of manufacturers in various indirect purchaser consumer class actions.
  • Representation of manufacturing company in action by prospective purchaser seeking to enforce letter of intent for sale of multimillion dollar manufacturing facility; secured dismissal of complaint on grounds that letter of intent was unenforceable.
  • Representation of owner of aircraft in dispute over cost of repairs and in securing the return of aircraft held subject to a mechanics’ lien.
  • Representation of third parties in responding to subpoenas, depositions and document productions.
  • Representation of an affiliate of Republic Financial Corporation in litigation against the general partner of a limited partnership for breach of fiduciary duties and breach of contract.

  • Represented Montford Bowling Partners in its acquisition of George Pappas’ Park Lanes.
  • Represented Management in the acquistion of assets of A.P. Services, Inc.
  • Represented Financial Resources Group LLC in its spin-off from LPL Financial.
  • Represented Carolina Select Brands LLC in its acquisition of Reid’s Fine Foods.
